An Account of the Salisbury Assize court of Lord Chief Justice Jeffrey
My lord,
From Winchester the commission of Oyer and Terminer has moved to Salisbury. Before giving you details of the day, I shall report that this commission is comprised of five judges: Lord Chief Justice, Lord Jeffreys, who does lead the rest; Lord Chief Baron, Sir William Montague; Sir Cresswell Levinz of the Common Pleas; Sir Francis Withens of the Kings Bench; and Sir Robert Wright of the Exchequer. This number of judges is deemed necessary because no Summer Assize was held due to the disturbed state of the west of England (viz-a-vie, the late duke of Monmouth’s rebellion) which has resulting in so many cases of High-Treason. They are accompanied by Mr Henry Pollexfen, acting as the crown counsel, who ensures those in the jail shall plead guilty.
Mr Pollexfen has cleared the Sailsbury jails of rebels by moving the life cases to Dorchester, where they can be better dealt with. Therefore, at this Salisbury Assize there were no rebels tried for high-treason, but one Mr Palmer did present a bill of indictment against a drummer in his Majesty’s service. This was for plundering Mr Palmer’s house. When it was proved in open court, by three witnesses, that Mr Palmer himself was in arms in Monmouth’s army. Jeffreys sent him to Taunton for committing High-Treason.
There are six men remaining, who did pleaded guilty for sedition. Five are sentenced to whipping in the market, but one, Stephen Moore, who’s only remark was to say “that he would never go to church till Monmouth was King” was sent to church by Jeffreys but the judge added that he shall be “whipped from the end of the town to his parish church and a second time from the farthermost part of the City to the Cathedral.”
With this the Assize commission left this place for Dorchester, where over 300 are said to await the Kings justice. In my next, I shall give you an account of the execution of Lady Lisle.
